Privacy Policy
This Privacy Policy describes how InVisionApp Inc. and its affiliates (collectively, the ‘InVision’ or ‘we’ or ‘us’ or ‘our’) collect, use and disclose information about you and what choices you have with respect to your information.
Information Collected Through Our Site and Services:
Personally Identifiable Information Collected by Us. In order for you to access the Services, we require you to provide us with certain information that personally identifies or may reasonably identify you or your household (“Personally Identifiable Information”). Personally Identifiable Information includes without limitation your name, personal pronouns, mailing address, home address, phone numbers, region, e-mail address, billing address, credit card information, ethnicity, age, payment information, model and type of vehicle driven, driver’s license number, VIN number, vehicles you lease or own, automobile accident history, traffic ticket and other violation history, car registration information, your emergency contact information and such other information you voluntarily provide us in connection with your use of our Services. We may collect Personally Identifiable Information either directly from you or through public sources or third party service providers.
We may use your Personally Identifiable Information in a variety of ways including, but not limited to:
- Provide you with Services and other product and service offerings;
- Fulfill the reason(s) you provided the information, we will use that information to process your request;
- Provide communications regarding our Services;
- Respond to emails or online requests or inquiries regarding our Services, past or future programs, or other information;
- Deliver and process surveys to enrich our Site and Services;
- Personalize and improve the usability of our Site and Services;
- Develop, fulfill and deliver our products and Services;
- Tailor content, advertising and marketing;
- Share with third parties as required by law and to pursue legal matters;
- Properly administer our Site, Services and conduct audits;
- Maintain our internal record keeping as required by law; and
- Keep our Site secure and protect our Site from malicious, deceptive, fraudulent or illegal activity, and prosecuting those responsible for that activity.
Vehicle and Driving Information. If you purchase automobile insurance from us, and in order to be eligible to participate in certain programs and discounts that we offer, we may collect certain information about your vehicle and your driving record. Additionally, if you opt to participate in the Computer Vision Program, you will be required to install a dashcam on all vehicles covered by our insurance and to download and use the Omnidya mobile application. The dashcam and Omnidya mobile application will be programmed to record certain vehicle information and general behaviors of drivers of your vehicle to evaluate several risk behavior factors to qualify you for certain insurance premiums that we offer, including without limitation your vehicle identification number, speed information, odometer readings, precise geolocation, battery use management information, battery charging history, electrical system functions, gasoline use management information, safety related data (including information regarding the vehicle’s SRS systems, brakes, security, e-brake), data about any issues that could materially impair operation of your vehicle; data about any safety critical issues; vehicle and drive state data (including the road segment data and current location); computer vision data such as tailgating, drowsiness detection, facial recognition, data about accidents or near accident-like circumstances involving your vehicle, data to confirm that your vehicle is online together with information about the current software version and certain telematics data collected by our dashcam and mobile application, and other data to assist in identifying and analyzing the performance of the vehicle and its driver (collectively, “Vehicle Data”). Vehicle Data also includes data that we receive about driving past driving records and traffic violations which we may obtain from third party service providers. Vehicle Data collected from our dashcam and Omnidya mobile application will be collected sporadically during the term of your use of our products and services and will include sporadic recordings both inside and outside of covered vehicles. Our dashcams and Omnidya mobile applications will never include any sound or audio collection mechanisms or have live-listening functionality.
We may use your Vehicle Data as described in this Privacy Policy, our Terms, and the Service Agreement, including without limitation to:
- Provide you with our Services and fulfill your requests for products and services based on our agreement with you;
- Prepare a risk profile for each driver in your account insurance plan to provide, maintain and process your insurance coverage and claims;
- Provide you with premium price options based on the Vehicle Data and risk profiles of the drivers under your account insurance plan;
- Collect information about certain aspects of a vehicle’s state and performance ;
- Collect information about the use of the vehicle in order to assess your qualifications to participate in our Computer Vision Program;
- Triage and fix software or product issues based either on our agreement with you, or our legitimate interests to ensure the safety, security and improvement of our products;
- Ensure reliability of our dashcam and mobile application, and perform maintenance, based on our legitimate interests to ensure the safety, security and improvement of our products and Services;
- Process claims and work with our insurance provider partners to assess and process insurance claims when applicable; and
- Improve our product and service offerings and customer services and outreach.
Certain Vehicle Data will be connected to your account. To protect your privacy, we will encrypt all Vehicle Data before storing it in our system. The only persons who will have access to certain Vehicle Data will include you and certain persons necessary for us to perform the purposes set forth in this Privacy Policy or any agreement between you and the Company. To protect your privacy, dashcam cabin images are not connected to your online account and will not be shared with anyone unless you enable data sharing. If you chose to enable data sharing, including if you participate in our Computer Vision Program, you agree that in the occurrence of a serious safety risk or a safety event like a collision, our Omnidya is allowed to access and utilize short video clips with our insurance underwriters to help us further process insurance claims and your eligibility to qualify for our offerings and discount programs.
The collection and analysis of Vehicle Data is a core part of the Computer Vision Program and why some customers choose Omnidya as its insurance provider, allowing for discounted rates on insurance premiums. However, if you no longer wish for us to collect Vehicle Data or any other data from your vehicle, please contact us to deactivate connectivity of our dashcam and immediately stop using our mobile application. If you choose to opt out of the collection of Vehicle Data, you will be immediately disqualified in participating in the Computer Vision Program.
Note it is your responsibility to confirm the consent of occupants and drivers of your vehicles to have Vehicle Data collected.
Account Information
If you become a customer of the Company, we may also collect information from or about you and the individuals you choose to be covered by your insurance plan. We may collect such information either through remote access or through your interaction with us. The information contained in your account includes without limitation, certain Personally Identifiable Information (such as your name, mailing address, drivers license number, vehicles information, and VIN number), the insurance plans that you qualify for or choose to purchase, claim history, payment method, Vehicle Data, driver risk profiles, and your qualification to earn certain discounted premiums in our Computer Vision Program (collectively, “Account Information”). Depending on which of our products and services you request, use or qualify for, not all of these types of information may be applicable to you.
We will use your Account Information to meet our contractual obligations that we made with you, to fulfill your requests for products and services, to process your payment for the products and services purchased, to ensure you qualify for certain discounted premiums that we may offer including as it relates to our Computer Vision Program, and to provide customer services and technical support as it relates to our products and services.
Traffic Data Collected
We may automatically track and collect the following categories of information when you visit our Site: (1) IP addresses; (2) domain servers; (3) types of mobile device accessing the Site; and (4) types of web browsers or operating system used to access the Site, and (5) website usage (including clicked links and buttons, scrolls, viewed pages, events, conversions) (collectively “Traffic Data”). Traffic Data is anonymous information that does not personally identify you. We may use it for marketing purposes, to tailor ad consent and personalization, to improve your experience on the Site, and to optimize website and mobile application performance, based on either your consent, or our contract with you and/or our legitimate interests in improving user experience and security.
Information from Cookies and Other Tracking Technologies
Cookies, web beacons and other tracking technologies may include very small text files that are stored on your computer when you visit certain web pages and mobile applications. Company collects directly, or through its use of third party applications and other technologies, user and use information through cookies, web beacons and other technologies about your web browsing and mobile application activities such as the address of the page you are visiting, the address of the referrer page you previously visited, the time you are viewing the page, your browsing environment, and your display settings. We may use cookies, web beacons and other tracking technologies to:
- Understand traffic patterns and the number of visitors to the Site and other third party websites and mobile applications that we may partner with;
- Understand how you use and interact with the Site;
- Process your requests, such as your input on insurance coverage applications, claim forms, questionnaires and other forms;
- Plan and improve our Services, programs, and other product and service offerings;
- Optimize your experience on our Site or your use of our Services;
- Provide non-Personally Identifiable Information auditing, researching, modeling, and reporting for our advertisers and other partners;
- Provide you relevant advertisements and content; and
- Properly manage our Site and Services provided in connection therewith.
Please note that some cookies, web beacons and other tracking technologies may be placed by a third party service provider who performs some of these functions for us. Third party service providers use of their cookies is subject to their own privacy policies, and not this Privacy Policy.
If you are concerned about cookies, web beacons and other tracking technologies, most browsers permit individuals to decline the use of cookies, web beacons and other tracking technologies. A user refusing cookies, web beacons and other tracking technologies may limit his/her ability to take advantage of all the features and Services we offer on the Site. For example, if you refuse to allow our mobile application to track your precise geolocation, you may be disqualified from participating in our Computer Vision Program.
We may also receive information about you from sources such as public databases, joint marketing partners, certified installers, affiliates and business partners, and social media platforms.
Sharing of Personally Identifiable Information:
We may disclose certain information we collect about you with other third parties, including without limitation to:
- Service Providers – Company may share your information with third parties that help us to maintain and operate our Site and to provide our Services. Our service providers include without limitation our payment processors, internet service providers, marketing and customer survey providers, data analytics providers, and operating systems providers. These third parties may only use such information to perform specific services that we have contracted with them for and may not use it for any other purpose. For example, we use third party service providers to help collect information about your driving record and vehicle history information. We may share Personally Identifiable Information with such service providers (such as your name, address, and drivers licenses number) so they may run searches and obtain the information that we engaged them to provide us.
- Underwriters and Insurance Providers – We may share your information as we assess whether to offer, renew or maintain your insurance. Additionally, we may need to share your information when you file or to further process an insurance claim.
- Affiliates and Partners – We may share information with our affiliates and third party partners, or to their employees, agents, contractors, and/or representatives, for: operational, management and administrative purposes; internal audit, legal, regulatory, security, insurance, financial, marketing, processing and other similar purposes; or as otherwise permitted or required by law. For example, we may post links to online stores and websites that are operated by third party partners and share cookie information or information relating to your IP address with such third parties if you click on such links. Additionally, we may operate certain programs through a partnership with other organizations and may share your information with them for the sole purpose of operating such programs.
- Professional Advisors – We may disclose your Personally Identifiable Information to our professional advisors, such as lawyers, bankers, auditors, brokers, and insurers, where necessary in the course of the professional service that they render for us.
- Third Parties that You Direct Us to Share With – We share information at your request or direction. We may also share your information with those that you have consented or directed us to share your information with. For example, we may share your name and other identifying information with our insurance underwriters.
- Third Parties in Connection with a Merger, Acquisition or other Business Transaction – We may share information if Company is involved in a merger, acquisition, sale of all or a portion of its assets, financings, joint ventures, reorganizations, dissolution, liquidations, or other event where we sell or transfer all or a portion of our assets. We will not provide you with notice before disclosure in such cases.
- Third Parties for Security and Compelling Disclosure Purposes – Company must disclose information about you in response to lawful requests by public authorities, including but not limited to meeting national security or law enforcement requirements. We may share information about you in connection with legal requirements, such as in response to an authorized subpoena or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, or investigate fraud. Such disclosures may be carried out without notice to you. We may also share your information with third parties if we believe, at our sole discretion, that such disclosure is necessary to avoid an imminent or likely risk of danger or harm to yourself or others.
User Choice Regarding Collection, Use, and Distribution of Personally Identifiable Information:
We do not sell your Personally Identifiable Information for monetary consideration, but we may share your Personally Identifiable Information to third parties as further described in this Privacy Policy. If you join our mailing list or waitlist and would like to be removed from such list, please send us an email at info@omnidya.com. You may also opt-out of our mailing list by following the opt-out instructions found in our communications. If you wish to update and/or correct certain Personally Identifiable Information that we maintain about you, such as your contact information (e.g., name, address, and phone number), you may do so by sending us an email or logging into your account (if applicable) and updating your information. We will process your request within a reasonable time once we are able to authenticate your request and verify your identity.
As noted above, most browsers and mobile devices let you remove and/or stop accepting cookies and tracking technologies from the websites you visit and mobile applications that you use. To do this, follow the instructions in your browser’s or mobile device settings. Note that disabling cookies and/or other tracking tools may prevent Company or its service providers from providing you certain features of our Site and may disqualify you from participating in our Computer Visual Program.
Security and Storage:
We have taken reasonable precautions to maintain the security and accuracy of the Personally Identifiable Information that we collect. However, despite our efforts, please be aware that no security measures are perfect or impenetrable and we cannot guarantee that the information you transmit or provide to us will be completely secure.
We will retain your Personally Identifiable Information for as long as needed to provide you with our Services or as needed to fulfill our own obligations, such as preventing fraud, meeting regulatory requirements, resolving disputes, improving our services or maintaining security, and in each case, as consistent with applicable law. We may retain non-Personally Identifiable Information that has been sufficiently aggregated or anonymized for a longer period.
Third Party Advertisers and Links to Other Websites and Mobile Applications:
During your use of our Site and Services, you may link to certain content that is created or hosted by a third party. Third parties, including our advertisers, affiliates and other content providers accessible through our Site, may have their own privacy and data collection policies and practices. We are not responsible for the actions, privacy, security or content of such third party websites and mobile applications and do not endorse such websites and applications. If you are asked to provide information on one of these websites or mobile applications, we encourage you carefully to review their privacy policy before sharing your information.
Children and Privacy:
Company is concerned about protecting children’s privacy. We encourage parents to actively protect their children’s privacy by instructing them never to provide Personally Identifiable Information to any individual or organization without parental permission. Company will never knowingly directly request Personally Identifiable Information from anyone under the age of 16 without prior verifiable parental consent. If we become aware that a child under 16 years of age has provided us with such information without appropriate consent, we will take appropriate action to remove such information from our files. If a parent or guardian becomes aware that a child under 16 years of age has provided such information to us, he or she should contact us at info@omnidya.com. There may be some areas within our Site where people may post messages or provide feedback, but those under the age of 16 are again discouraged from providing any Personally Identifiable Information. If a visitor known to be a child (younger than 16) sends an e-mail to Company, we will only use it to respond to the e-mail and not to create profiles or otherwise retain the information.
Geographic Restrictions:
We may limit the availability of our Site and Services to any person or geographic area at any time. If you access our Site from outside the United States, you do so at your own risk.
IF YOU ARE A USER ACCESSING OUR SITE AND SERVICES FROM ANY OTHER COUNTRY WITH LAWS OR REGULATIONS GOVERNING PERSONALLY IDENTIFIABLE INFORMATION COLLECTION, USE AND DISCLOSURE THAT DIFFER FROM THE LAWS OF THE UNITED STATES, PLEASE BE ADVISED THAT THROUGH YOUR CONTINUED USE OF OUR SITE, YOU ARE TRANSMITTING YOUR PERSONALLY IDENTIFIABLE INFORMATION TO THE UNITED STATES AND YOU CONSENT TO THAT TRANSMISSION. ADDITIONALLY, YOU UNDERSTAND THAT YOUR PERSONALLY IDENTIFIABLE INFORMATION MAY BE TRANSMITTED TO AND PROCESSED IN COUNTRIES (INCLUDING THE UNITED STATES) WHERE LAWS REGARDING PROCESSING PERSONALLY IDENTIFIABLE INFORMATION MAY BE LESS STRINGENT THAN IN YOUR COUNTRY.
California Residents: Your California Rights:
Under California Civil Code section 1798.83, California resident have a right to request a list of all third parties to which we, during the immediately preceding calendar year, have disclosed certain Personally Identifiable Information for direct marketing purposes. We do not share Personally Identifiable Information about you with any third parties for their own marketing purposes. We are only required to respond to such a request once during any calendar year. To make such a request, you should contact us as listed below. Please be aware that not all information sharing is covered by the California privacy rights requirements and only information sharing that is covered will be included in our response.
Company does not track its customers over time and across third party websites to provide targeted advertising and therefore does not respond to web browser’s Do Not Track (DNT) signals. However, some third party websites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. You may set the DNT signal on your browser so that third parties (including advertisers) know you do not want to be tracked.
Nevada Residents: Your Nevada Privacy Rights:
Nevada law requires website operators to provide a way for Nevada consumers to opt-out of the sale of certain information that the website operator may collect about them. Company does not “sell” your Personally Identifiable Information to third parties as defined in Nevada law, and will not do so without providing you with notice and an opportunity to opt-out of such sale as required by law. Modification to this Privacy Policy:
We reserve the right at our discretion to make changes to this Privacy Policy at any time, and all such changes shall be immediately effective. When we make changes, the “Effective Date” of this Privacy Policy will be revised. Your continued use of our Site following the posting of changes to this Privacy Policy will mean you accept those changes. We encourage you to review the Privacy Policy each time you visit the Site. Without limiting the effectiveness of the foregoing, in the event of certain changes to this Privacy Policy, you may also be required to assent to the new terms, and you may also be notified by email if we have your email address. If any modification is unacceptable, you should stop using the Site and our services.
